Introduction

Macedonia’s RTI law is relatively strong, which is highlighted by a near-perfect rating for its expansive scope. Other assets of the legislation include its robust requesting procedure, its mostly compliant harm-test exception regime, and a series of well-defined promotional requirements. That being said, several legislative flaws must be remedied to improve the right to information. Notably, the law must enhance the ability for the administrative oversight body (Commission for Protection of the Right to Free Access to Information of Public Character) to fulfil its supervisory mandate, by broadening its permissible functions, including the powers to review classified documents and order its declassification where appropriate. Another key area for improvement is the creation of a trump provision to ensure that information disclosure is not subject to exceptions established in other laws.
